Position Statement on the Amendments to the Proposal for a Directive on Concessions, 2011/0437 (COD)


Short summary:

In its paper of 9 November 2012, Municipal Waste Europe supports selected amendments tabled on the proposal for a Directive on Concessions. The amendments chosen support the freedom of choice for contracting authorities, inter-communal cooperation and the maintenance of exclusive rights where they are currently enforced. The maintenance of waste management services as service concessions is also upheld.
We find that the Commission’s proposal of 90% municipal waste is damaging to existing public investments and should also be seen in the context of the current economic crisis and prefer instead that the activities of contracting authorities “are subject to the contract”. Any decision which changes the usage of existing public installations would cause huge cost increases to affected citizens.
